This Dynata Mobile Applications Privacy Policy (“Mobile Privacy Policy”) sets out what information we collect through mobile applications provided by Dynata and its affiliated companies, how we collect it, and what we do with it. Dynata Global UK Limited (formerly known as e-Rewards, Inc.) (“Dynata”, “our”, “we” or “us”) located at 5800 Tennyson Pkwy, Suite 600, Plano, TX 75024, USA, is an online market research panel for individuals no younger than thirteen (18) years of age at the time of enrollment (“you” or “Member”). Dynata is committed to protecting your privacy. Because protecting your privacy is important to us, you may always submit concerns regarding our Mobile Privacy Policy or our privacy practices by contacting us by any means provided in the “How to Contact Us” section below. If you choose to write us an email, please reference the Mobile Privacy Policy in your subject line. Dynata will attempt to respond to all reasonable concerns and inquiries expeditiously. Our general Privacy Policy covers information you submit through our website or membership program (governed by the Panel Terms and Conditions) other than through the Apps. This Mobile Privacy Policy covers the information collected through Jet Opinions Mobile application (“App”) or the Jet Opinions Mobile Plus application (the “App+”, and both the App and App+ are referred to collectively as the “Apps”). The Apps are governed by the End User License Agreement (“EULA”) located at: https://www.jetopinions.com/mobile-eula .

For All Non-US Residents

Dynata may transfer your information (including your personal information) to, and process it in, the United States and other countries from time to time for the purposes of participating in the Jet Opinions program. By submitting your information to the application, you consent to such transfers taking place.

Dynata may also transfer, store, process or use your personal information in other countries. This may happen if Dynata's related entities are located overseas, if we outsource certain activities to overseas countries, or if transactions, information, services or products have an overseas connection. You consent to the collection, use, storage and processing of your personal information in the United States and in other overseas countries, where it will be stored and used for the purposes described in this Mobile Privacy Policy.

In particular, your personal information may be disclosed to third parties in the United States, and such other countries in which Dynata, Dynata's service providers (e.g., Canada and India), or their, or our, computer systems may be located from time to time, where it may be used for the purposes described in this Mobile Privacy Policy. To the maximum extent permitted under the Australian Privacy Act 1988 (Cth) ("Australian Privacy Act") or the New Zealand Privacy Act 1993 ("New Zealand Privacy Act"), Dynata will not be responsible for such use (or for any breach). In these circumstances, you consent to the collection, use, storage and processing of your information (including your personal information) in those countries. Where such parties are located outside of Australia or New Zealand, you may have rights to enforce such parties' compliance with applicable data protection laws, but you may not have recourse against those parties under the Australian or New Zealand Privacy Acts in relation to how those parties treat your personal information.

Dynata complies with the EU Data Privacy Directive to the extent it applies to information Dynata collects, processes, controls and maintains.

You Will Not be Spammed by Dynata

Pursuant to the Panel Terms and Conditions, we offer an opt-in email program. Under such program, you will periodically be sent email communications from Jet Opinions inviting you to participate in surveys, as well as occasional Member Service emails (newsletters, Reward fulfillment communications and program announcements) and promotional emails from Dynata on behalf of our partners and sponsors. If you are located in Australia or New Zealand, you may opt into the program when prompted by Dynata.

If you are located outside of Australia or New Zealand, you may opt into the program by responding to an email invitation from a participating sponsor or partner.

If you no longer want to receive these email communications, you must request that Dynata discontinue sending you email or cancel your Dynata membership as described in “Our Opt-Out Policy” section below.

The Information We Collect and How We Use It

To use our Apps, you are required to give us certain contact information (e.g., your full name, postcode, date of birth, email address, etc.). In addition, if you desire to use the functionality of certain surveys and receive membership credit for completing such surveys, you are required to turn on geo-location tracking services through your device’s GPS functions. All of the following information is required to be able to use the Apps and take surveys. If you fail to provide this information, you will be unable to use the Apps.

a. Anonymous Singular Summary and Aggregate Statistical Information
Personal demographic and profile data regarding our Members may be shared with our sponsors, our partners and other third parties on an anonymous singular summary basis or an aggregate basis. Anonymous singular summary information is data that describes the interest profile and demographics data of a Dynata Member without specifically identifying the Member. For example, this data does not contain personally identifying information such as a name or email address. Aggregate information is data that describes the interest profiles and demographics of Dynata Members as a group (in the aggregate). This data describes group interest profiles (for example, car brand preferences of Dynata Members as a group) and group demographic information (for example, the average age of Dynata Members as a group).
b. Personally Identifiable Information
Dynata may provide personally identifiable information (or personal information, as defined under the Australian Privacy Act 1988 (Cth) and the New Zealand Privacy Act 1993) to our sponsors, our Reward Partners, our Panel Partners, our Marketing Partners, our clients and third parties for the following purposes: (i) the augmentation of Member information with statistical information available from a third party, (ii) independent auditing and/or verification of respondent data for quality control purposes, (iii) the suppression of Member contact information from email communications that a Member has not consented to receiving, and (iv) for any other purposes specified in this policy or notified to you at the time we collect your information.

When our sponsors, our Reward Partners, our Panel Partners, our Marketing Partners, our Clients and other third parties receive personally identifiable information from Dynata, they are required to sign legally binding agreements that hold them accountable applicable data privacy laws and relevant industry standards. By entering into such agreements with Dynata, our sponsors, our Panel Partners, our Marketing Partners, our Rewards Partners, our clients and other third parties agree that their use of survey response data will be limited to research purposes and that all personally identifiable information will remain confidential. Unless you provide prior consent, personally identifiable information that is shared with our sponsors, Reward Partners, Panel Partners, Marketing Partners, clients and other third parties will not be transmitted to further parties and will not be used in conjunction with sales and/or marketing communications or promotions.

We reserve the right to disclose your personally identifiable information as required by law when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our website. If you are located in Australia or New Zealand, we may also disclose your personal information as permitted under the Australian Privacy Act or the New Zealand Privacy Act, such as to lessen or prevent a serious threat to the life, health or safety of any individual or to public health or safety.

In the event that Dynata goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, you agree that your personally identifiable information may be transferred to such entities. In such cases, we may publish certain details about such event on our website or through the Apps. Unless you expressly request us delete your personally identifiable information by contacting us by any means provided in the “How to Contact Us” section below, Dynata may use and retain the information collected through the Apps for as long as it is required for the purposes for which the information may lawfully be used (which is for as long as you have an active account with us or as long as necessary to serve the business purposes of Dynata in compliance with this policy).
c. Surveys
Dynata may invite you to participate in online surveys through the Apps. The information requested in these surveys may include, but is not limited to, your opinions, purchase history, and purchase intent regarding consumer and/or business products and services. These surveys may also request information defined as sensitive (e.g. data directly or indirectly revealing racial and ethnic origins, political, philosophical or religious opinions, trade union affiliation, health or sexual life). Again, you are not required to provide us with this information if you do not want to and failing to provide this information will not preclude you from participating in the Dynata program but it may restrict your use of certain features of the Dynata program, such as location based surveys. The information collected by these surveys is used in connection with Dynata market research sponsored by third-party companies and by Dynata to customize and tailor your experience with the Dynata program, the Apps and website. We reserve the right to share this information with third parties for this purpose.
d. Your Electronic Relationship with Our Sponsors
Subject to the terms of the Panel Terms and Conditions or EULA, we may share select enrollment information, including your full name, postcode and your email address, with the sponsor who invited you into the program and the sponsor from whom you selected a Welcome Gift. If you so desire, this will enable you to foster a relationship with the sponsors and receive electronic communications from them. If you are located in Australia or New Zealand, we will prompt you first to obtain your consent for your personal information to be shared with the sponsors and to receive such communications from them. While we enter into sponsorship agreements only with major brands that undertake to respect our Members’ privacy, Dynata will not, to the maximum extent permitted by law, be responsible for our sponsors’ actions concerning your information.
e. Agents/Service Providers
We use other third parties, such as a fulfillment company, to fulfill gift card redemptions. When you redeem for a gift card, we will share your name and address as necessary for the third party to provide that service.
f. Supplemental Information
In order to provide survey opportunities to you, we may on occasion supplement the personally identifiable information you submitted to us with information from third party sources. Where the supplementary information contains personal information about you, you authorize us to collect this information from third parties.
g. ID Verification
We may use a third party supplier to verify your identity as stipulated in the ISO 26362 standard for access panels.
h. Enhancement of Profile Information
We purchase marketing data from third parties and add it to our existing user database to provide enriched analytical data for our clients’ use. We will process, use and collect such information in compliance with this policy. Where the marketing data contains personal information about you, you authorize us to collect this information from third parties.
i. Other Websites
This Apps and our site may contain links to other Internet sites that are not operated or controlled by Dynata. We cannot control and are not responsible for the privacy practices or the content of such websites.
j. Non-Electronic Communications with You
In addition, we occasionally may employ other companies to perform Welcome Gift or Reward fulfillment mailings on our behalf. They may have access to the personal information needed to fulfill their functions.
k. Flurry
We are using Flurry, Inc.’s (“Flurry’s”) software development kit (“Flurry SDK”) in the Apps which you have downloaded on your device. Under our agreement with Flurry, Flurry will provide us with certain data about your device containing the Apps and your use of the Apps. Flurry’s collection and use of data from end users of mobile applications using the Flurry SDK or other Flurry advertising services (“Flurry Data”) are described in Flurry’s privacy policy which you can access here: http://www.flurry.com/privacy-policy.html. You may continue your Dynata membership and opt out of Flurry’s collection of data from your device by following the instructions located at http://www.flurry.com/user-opt-out.html. If you opt out of Flurry’s collection of data from your device, Flurry will discontinue sharing data with us. If you do not opt out of Flurry’s collection of data from your device, to the extent that the data includes personal information about you, you authorize us to collect such information from Flurry. You may have other third-party applications on your device which contain the Flurry SDK (“Third-Party Apps”). We may be engaged by the owners or licensors of the Third-Party Apps (“Third Parties”) to provide survey research services regarding you and your use of the Third Party Apps. Upon the request of such third party to us and to Flurry, Flurry may share data that it collects from your device related to that Third-Party App with us. The data collection and use practices described in Flurry’s privacy policy or any other Third-Party’s privacy policy are independent from our data collection practices through your participation in the Apps or our other mobile applications. To the extent that the data from the Third-Party App that is shared with us includes personal information about you, you authorize us to collect such information from Flurry. We may share your profile data, survey responses and, if you use the App+ application, your mobile behavioral data with Flurry, and Flurry may associate such information with Flurry Data that is specific to your device. When Flurry combines your profile data and survey responses collected through the Apps, and, if applicable, your mobile behavioral data collected through the App+ application, with Flurry Data specific to your device, Flurry may use the resulting data subject to applicable law and industry standards. When Flurry shares Flurry Data with us as described above, we may use such Flurry Data in the same manner as your profile data, survey responses and, in the case of the App+ application, your mobile behavioral data, described herein. Please note that cancelling your Dynata membership or deleting the Apps from your device will not opt you out of Flurry’s collection of data through Third-Party Apps on your device that contain the Flurry SDK.

How to Edit or Correct Your Personal Information

You may update your contact information by accessing the “My Account” area of the member website https://www.jetopinions.com/login . When you are finished entering your updated information, click the appropriate button on the page to save your changes. Your changes will be recorded immediately but some in-process Member communications may still be based on your old information. If there is incorrect information on your Dynata account statement, please contact us by any means provided in the “How to Contact Us” section below. To delete your personally identifiable information from the Dynata database, please contact us by any means provided in the “How to Contact Us” section below. We will respond to your request within 30 days of its submission.

We will retain your personal information unless your account is deactivated or terminated. If you wish to terminate your account or request that we no longer use your personal information to provide you services, contact Member Services by any means provided in the “How to Contact Us” section below. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We are Committed to Data Security

The Apps have certain commercially reasonable security measures in place to protect against the loss, misuse, and alteration of the information submitted through Apps. As with any transmission over the Internet; however, there is always some element of risk involved in sending personal information online. Your email address, password and cookie will be required to redeem Rewards, update your personal information (name, email address, etc.), and update your Member profile data. Remember to keep your password private and secure — you should not share this information with anyone. If you have any questions about the security of our Apps, please contact us through any means as stated in the “How to Contact Us” section below.

We are Committed to Children’s Privacy

a. Dynata Does Not Seek To Collect From Children Under 18 Years Of Age

b. Australian Minors
If you are located in Australia, between 13 and 15 years of age and a User of one of our Apps, this section applies to you. You will not be able to use the Apps if your parent/guardian has not provided this consent.

Do Not Track

Because we track mobile usage information through the use of cookies and other tracking mechanisms, your selection of the “Do Not Track” option provided by your device browser may not have any effect on our collection of cookie information for the purposes described in Section 4. The only way to completely “opt out” of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or mobile device to delete and disable cookies and other tracking/recording tools. However, getting a “Do Not Track” signal actually to work as you might want can be very difficult. Using browsers as an example, not all tracking technologies can be controlled by browsers; unique aspects of your browser or device might be recognizable even if you disable a tracking technology; not all settings will necessarily last or be effective; even if a setting is effective for one purpose, data still may be collected for another; and even if one website observes a “Do Not Track” signal, that website usually will not be able to control what other websites do.

Our Opt-Out Policy

If you would like to opt out of Dynata membership, you may request that your membership be cancelled and your account closed by contacting us by any means provided in the “How to Contact Us” section below. You can, at any time, withdraw your consent to our use of your personal data as described in this Privacy Policy by cancelling your membership. The use of any other mechanism to request that your membership be cancelled could result in the delay of your membership cancellation.

You may request that Dynata discontinue sending you emails without opting out of your Dynata membership by clicking on the unsubscribe link found at the bottom of email communications from Dynata. To resume receiving email from Dynata, click on My Account from the Member website and update the number of email messages you would like to receive. Please note that deleting either of the Apps would not result in opt out of e-mail communication or membership in the Jet Opinions Program.

Changes to the Privacy Policy

We reserve the right to update this Mobile Privacy Policy from time to time by posting an amended version of the statement to the Dynata website located at: https://www.jetopinions.com/mobile-privacy . Please refer to this policy regularly. If we change how we use your personally identifiable information or update our email practices, we will notify you on the Member home page of our website, through the Apps, via email or through any other method allowed by applicable law.

Trans-National Data Flow

Dynata adheres to the Organization for Economic Co-operation and Development (OECD) guidelines, specifically the Fair Information Practices governing the protection of privacy. This involves the trans-border data flows of personal data. International Data Transfers are defined as the transmission of personal information from one jurisdiction to another. Many jurisdictions, most notably the European Union (EU), place significant restrictions on such transfers. The EU requires that the receiving jurisdiction be judged to have “adequate” data protection practices.

Dynata transfers data between the EU and the U.S. in accordance standard contractual clauses for the transfer of personal data to processors established in third countries (“Model Contract”) pursuant to the Commission Decision 2010/87/EU of 5th February, 2010.
